Copyright Registration

State registration of copyright registration and contracts relating to the author's rights to the product in accordance with the Law of Ukraine "On Copyright and Related Rights" ( hereinafter - the Law ) and CMU from 27.12.2001 № 1756" On state registration of copyright and contracts relating to the author's right to work"(published in the bulletin " Official Bulletin of Ukraine" № 52 11.01.2002) ( hereinafter - the Decision ).

I. Registration types:

Copyright Registration.
Copyright Registration authors work.
Copyright Registration employer to an employee's work.
Registration of contracts relating to the right website to work.
Register
Agreement on transfer (alienation ) of property rights in the work.
Agreement on the transfer of the exclusive right to use the work.
Register
Agreement on the transfer of non-exclusive rights to use the work.

II. Documents required for registration of copyright and contracts relating to the author's right to work.

1. Application for registration of copyright in a work of authors should include:

statement set out in the Ukrainian language in the prescribed form
copy of a work
document proving the fact and date of publication of the work (if available )
document or copy of a document confirming payment of the fee for preparation for copyright registration or a copy of the document confirming the existence of benefits
document confirming payment of the fee for registration and issuance of certificate ( supplied by the author after receiving the written decision on the registration of copyright in the work ), or a copy of the document confirming the existence of benefits
power of attorney executed in the prescribed manner, if the application is filed confidant.

2. Application for copyright registration of the employer to an employee's work, other than the above materials must also contain a document confirming that the exclusive property right of an employee's work belongs to the employer (in accordance with Article 16 of the Law ).

3. Application registration agreement on the rights of the author of a work shall include:

statement set out in the Ukrainian language in the prescribed form
copy of a work
instance of copyright agreement certifying transfer (alienation ) of property rights to the product (according to Article 31 of the Act) or a copy of a copyright agreement on the transfer of rights to use the work (according to Article 32, 33 of the Law )
document confirming the existence of property rights transferred (if necessary )
document or copy of a document confirming payment of the fee for the preparation for registration of the contract
power of attorney executed in the prescribed manner, if the application is filed confidant.

III. Examination of an application and licensing decisions.

Consideration of the application and the decision on registration of copyright in a work or refusal of registration shall be made within a month of receipt of the application properly executed documents.
If the application meets the requirements, the decision on registration of copyright prava.V Otherwise, the applicant provided an informed decision to refuse registration.

applicant within three months from the date of receipt of the decision on registration of copyright in the work shall submit a document confirming payment of the fee for registration and issuance of certificate.

Based on the decision on registration and a document confirming payment of the fee for registration and issuance of certificate of registration information on copyright in the work shall be entered in the State Register of certificates of registration of copyright in the work.

Registration of contracts relating to the right website to work.

Consideration of the application and a decision on registration of the agreement on the rights of the author of a work is carried out within a month of receipt of the properly executed documents application.

Objects copyright (Article 8 of the Law).

Objects of copyright are works of science, literature and art, namely:

literary written works of fiction, journalistic, scientific, technical or other nature ( books, pamphlets, articles, etc. )
performances, lectures, speeches, sermons and other oral works;
computer programs
database
musical works, with or without text
dramatic, musical and dramatic works, pantomimes and choreographic and other works created for the stage show, and their productions;
audiovisual works
work of art
works of architecture, urban planning and landscape - landscape art
photographic works, including works made by methods similar photos
works of applied art, including works of decorative weaving, pottery, carving, casting, art glass, jewelry, etc., if they are not protected by the laws of Ukraine on the legal protection of industrial property
illustrations, maps, plans, drawings, sketches, three-dimensional works relating to geography, geology, topography, engineering, architecture and other activities
stage processing products referred to in paragraph 1 of this Part, folklore and processing suitable for the stage show;
derivative works
collected works, collections of folklore, encyclopedias and anthologies, collections of conventional data compiled by other works, provided that they are the result of creative work on the selection, coordination and streamlining the content without violating copyright for works belonging to them as integral parts of
texts translation for dubbing, audio, subtitling Ukrainian and foreign languages ??other audiovisual works;
